TERMS OF SERVICE / TERMS & CONDITIONS

These Terms of Service/Terms & Conditions (“Terms”) govern your use of www.rustemalali.com (the “Website”) and any services provided by Rüstem Alali (“we”, “us”, “our”). By accessing the Website, contacting us, booking an appointment, or placing an order, you agree to these Terms.

2) Scope of Services

Rüstem Alali operates as an appointment-based bridal & couture house. Depending on availability and the agreed scope, we may provide:

• Bespoke Bridal (custom-made wedding gowns)
  
  

• Couture Eveningwear (custom or made-to-measure where applicable)
  
  

• Prêt-à-Porter (selected ready-to-wear pieces, where offered)
  
  

• Partner / Wholesale / Private Label (OEM/ODM) and Capsule Collections for select boutiques (subject to separate commercial terms)
  
  

Any timelines, pricing, inclusions, or deliverables are confirmed in writing (email/WhatsApp) and/or in an order confirmation.

3) Appointments & Consultations

3.1 Booking & Confirmation
Appointments are confirmed once you receive written confirmation from us and (where applicable) any consultation fee/deposit is paid.

3.2 Lateness
If you arrive late, your appointment time may be shortened to respect other bookings.

3.3 Rescheduling
Rescheduling is possible subject to availability. We recommend requesting changes at least [48/72] hours in advance.

3.4 No-Show Policy
No-shows may result in forfeiture of any appointment/consultation fee and may require a new deposit to rebook.

4) Bespoke & Made-to-Measure Orders

4.1 Process & Approval
Bespoke work typically includes: consultation → design direction → measurements → fittings → final delivery. You agree that bespoke items are made specifically for you, based on approved design decisions and fitting outcomes.

4.2 Design Decisions
Final design details (silhouette, neckline, sleeves, train length, fabric, embellishment, lining, color tone, etc.) are confirmed prior to production. Once production starts, changes may be limited or may require additional cost and time.

4.3 Measurements & Fittings
You are responsible for attending scheduled fittings and providing accurate measurements. Fit outcomes can be affected by weight changes, posture changes, pregnancy, and undergarments/shoes. We may request you bring the intended shoes and undergarments to fittings.

4.4 Timelines
Timelines vary by season and complexity. Any target dates (wedding/event date) must be shared before order confirmation. Rush requests may be accepted at our discretion and may incur rush fees.

4.5 Bespoke Refund Policy
Because bespoke items are custom-made, payments are generally non-refundable once production has started, except where required by applicable law or in cases of our confirmed non-performance.

5) Pricing, Payments & Currency

5.1 Quotes
Quotes are valid for [7] days unless otherwise stated. Prices may change due to fabric availability, material cost changes, and scope changes.

5.2 Payment Schedule
Typical structure (unless otherwise agreed in writing):

• Deposit to secure production slot

• Final balance before delivery/collection/shipping
  
  

5.3 Accepted Payment Methods
Payment methods will be communicated at the time of booking/order.

5.4 Taxes & Duties
Local taxes may apply. For international deliveries, import duties/taxes are the customer’s responsibility unless otherwise agreed in writing.

6) Changes, Cancellations & Termination

6.1 Client-Requested Changes
Any change after confirmation may affect delivery timelines and pricing. Additional work is billed separately.

6.2 Client Cancellation
If you cancel a bespoke order after production begins, amounts paid may be retained to cover work completed, materials sourced, and production capacity reserved, except where otherwise required by law.

6.3 Our Right to Refuse/Terminate
We may refuse or terminate service where: abusive behavior occurs, repeated no-shows happen, non-payment persists, or compliance with these Terms is not met. In such cases, we will communicate the status of work and any applicable charges fairly and in writing.

7) Delivery, Collection & Risk

7.1 Collection
Where applicable, items can be collected by appointment.

7.2 Shipping
If shipping is agreed, you must provide accurate delivery details. Risk may transfer upon handover to the courier, unless otherwise required by applicable law.

7.3 Care & Handling
You are responsible for appropriate handling, steaming, and storage. We provide care guidance where possible.

8) Prêt-à-Porter (If Offered)

For ready-to-wear pieces, the applicable exchange/return terms (if any) will be specified at the point of sale and may differ from bespoke policies.

9) Partner / Wholesale / Private Label (B2B)

B2B orders (wholesale, private label OEM/ODM, capsule collections) are subject to separate commercial terms including MOQ, sampling, lead times, payment terms, tolerances, and quality claim processes. Any B2B cooperation is confirmed only upon written agreement.

10) Intellectual Property

All Website content, designs, patterns, images, brand assets, logos, and materials are protected by intellectual property laws. You may not copy, reproduce, distribute, or commercially exploit any content without prior written permission.

11) User Content & Permissions

If you send us reference images, inspiration, or materials, you confirm you have the right to share them. If you grant us permission to use your photos/videos for portfolio or marketing, this will be handled via separate written consent where required.

12) Disclaimers

• Colors and fabric appearance may vary due to lighting, screens, and photography.
  
  

• Couture and bespoke work is handcrafted; minor variations may occur and are part of artisanal production.
  
  

• Fit depends on measurement accuracy, fitting attendance, and consistency of undergarments/shoes used in fittings.
  
  

13) Limitation of Liability

To the extent permitted by applicable law, Rüstem Alali shall not be liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amounts paid for the specific service/order in dispute, except where liability cannot be limited by law.

14) Privacy

Our processing of personal data is governed by our Privacy Notice (KVKK) and Cookie Policy, available on the Website.

15) Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Türkiye. Any dispute shall be subject to the jurisdiction of the competent courts and enforcement offices in Istanbul, unless mandatory consumer protection rules provide otherwise.

16) Updates to These Terms

We may update these Terms from time to time. The latest version will be posted on the Website with an updated effective date.
